By a decision on June 27, 2022, the Council of State confirmed the sanction of 35 million euros pronounced by the CNIL against Amazon in 2020. The company placed cookies on users’ computers without consent advance or satisfactory information.
In line with its decision of January 28, 2022 rendered in the context of the sanction against GOOGLE , the Council of State confirmed the competence of the CNIL to impose sanctions on cookies outside the one-stop-shop mechanism provided for by the GDPR.
The Court recalled that the CNIL was competent to sanction breaches of article 82 of the Data Protection Act, even in the event that the data controller is not established in France, but has on the territory French of an establishment involved in activities related to the processing carried out, here the promotion and marketing of advertising tools by the company Amazon Online France.
